Does an enemy relenting a WP duel mean they have failed said duel and trigger smell fear.

eg, if the Rogue Necro is engaged with a terror tot and Lilith tangles shadows up to the tot (which relents) does that mean the Rogue can take a ML action against either the tot or Lilith?

Yes. Relenting means you tie with the attacker, and tie means the defender fails the duel.

The necro will probably have trouble reaching the tot aince it's after the resolution of the current action but you might get to attack whatever was placed near you if your opponent leaves that within range.
