McCabe, Emissary

So:

 

We have McCabe with 3 McCabe upgrades

We have Emissary with 4th one.

 

McCabe activates. Can he use "Loan" and get the 4th item, or can`t as he can`t have 4 upgrades?

"Loan: When this model Activates, or before a
friendly model within 10" is killed or sacrificed,
this model may discard any Upgrades with the
Restriction Lucas McCabe from any friendly
model within 10" and attach them to itself."

41) Q: Some Actions/Abilities allow models to attach Upgrades during the game. Do these Actions/Abilities need to adhere to the restrictions listed on the Upgrade, or can they be attached to any model?

A: Upgrade restrictions only affect the hiring process, and have no in game effect, so these Upgrades may be attached to any model. If there are any restrictions they will be noted in the Action or Ability’s description. It is worth noting some such Actions and Abilities bother noting “ignoring restrictions” but this is simply reminder text which was put on when there was space available.

Not sure on the McCabe side, but Jack Daw's curses do not count toward the limit when applied to another model.

Limit of upgrades only applies while recruiting the crew, so McCabe can use "Loan" to get the fourth upgrade.
