The point of contention is that charge is normally a (2) action so at the point of choosing the action you are technically not choosing a (1) action until the ability kicks in. My argument for allowing it is that when you check to see if the action is legal you then discard the upgrade to make it a (1). There are plenty of times when Perdita, Abuela or Lucius would want to "obey" the executioner to do that charge outside of it's activation. Basically Obeyer: I hereby declare the (1) charge action. Confused opponent: What, charge is a (2) not a (1). Obeyer: No, because as part of declaring that charge I discard this upgrade to make it a (1). No longer confused opponent: I see, go ahead.
