Smell Weakness vs. Nihilism

Question

Hey guys,

me again with a rules question. If I use the Zombie Chihuahua's Smell Weakness on a model with Nihilism, can this model be affected with poison? We are debating becuase Nihilism says that gaining a condition for the model is optional. Does this count as an immunity which can be removed by Smell Weakness?

This is the definition of Immunity as far as the rules are concerned:

Quote

Immunity

A model immune to a game rule cannot be affected by that rule. The model never performs a duel to which it is immune. A model immune to Horror Duels, for instance, simply does not perform the duel.

A model immune to a Condition can never receive the Condition. If an Attack (or other source) causes damage and applies a Condition to a model, the model still suffers the damage, but it would not gain the Condition if it is immune. If a model gains immunity to a Condition while it has the Condition, it immediately removes the Condition.


Being able to choose not to gain a Condition is not immunity.  Just like the Rail Golem's Forged In Fire ability:

Quote

Forged in Fire: At the end of the Turn, this model does not end its Burning Condition and it does not suffer damage from the Burning Condition.

is not immunity to Burning.
