  2. Thread title says it all. Looking for a Shadow Emissary seems to be out everywhere.
  3. I am in the same boat but have a slightly different question. I have the arsenal decks, so I see how that works I believe. However I have a bunch of metal models I want to continue using. Some of the new box sets have new models that do not seem to be available without buying the entire new box set. Is there any way to get these new models without buying a new box set? The models I am thinking of are Barbarosa with Lilith and the Nanny with Molly. Another question, my primary reasons for quitting before were balance issues and constant rules changes. Do people believe these have been addressed?

  5. I'll agree with the others, only one Rat Catcher to start and only one or two Stolen to start. Keep a decent cache and add more rats. You want to try and out activate your opponent, saving Hamelin for last or near the last. By then on the first turn someone will hopefully be within range to make Insignificant. If not on Turn 1, by Turn 2 you should again out activate your opponent and have targets for Insignificant.
  6. Yeah, I saw that wording, I just didn't see anything that said that multiple slows do not stack. They aren't technically from the same source, one is a characteristic and the other is from being summoned. I was pretty sure that was the way they were intended to work, but it will probably get questioned at our tourney this weekend, so I wanted something to point to.
  7. Based on my reading of the tactica it seems that the following tactic works, but I cannot find the support in the Rules Manual. It may have been answered in the Rules forum, but I couldn't find it there either. Malifaux Rats are slow. If a rat is killed within 6" or Hamlin or a Rat Catcher a new rat is summoned. Summoned figures are slow on the turn that they are summoned. So a strict reading of those would say that a summoned rat would have 0 AP. My first thought was that the same effect doesn't stack, but I don't see that spelled out for Slow, just a general rule that the same effect from the same source doesn't stack. To me these aren't from the same source. However, the tactica on Hamlin references activating rats, having the rat catcher use the kill rats ability and activating the newly summoned rats. So help me out justifying this or am I wrong? If I'm wrong, not sure if I see the point in having the rat catcher kill rats and rats become very slow.

  10. That has been my complaint all along. The trademark claim was the first stab at this, since it failed, now the patent argument can be made. The patent angle may have more merit, especially if the patent is granted. Even if the competitor isn't infringing the patent, it costs money to hire counsel to investigate and possibly fight the claim. You are correct a process can be patented. However, that leaves you open by publicizing the process in the application and someone else can do the same thing but not follow the same process and not run afoul of your patent. I believe that is why our process with the compressors is not patented. Our secret process may be patentable, but to get it patented would require describing it in an application. Thus far, no one has been able to reverse engineer our process, so keeping it secret has afforded better protection than a patent would. All patents eventually expire. Regardless we've never sent out "courtesy" letters to competitors or customers of competitors suggesting that their products might be interfering with our IP or secret processes.
  11. I'd like to see this patent when and IF it comes out. I've done a search of the U.S. Patent Office's database looking at patents and patent applications and thus far have not found anything with an inventor or assignee named "Battle Foam" or "Romeo Filip." Nor have I found anything with an inventor or assignee state of Arizona with "foam" in any field. The terms "Battle" and "Foam" in all fields generated far too many hits for me to bother looking over. I've never really heard of sending a letter out "warning other businesses" in advance of receiving a patent. Again, I'm not a patent lawyer, but I have had some exposure to the area. I've seen numerous letters from one business to another claiming that the other business is infringing on one of their patents or trademarks. When you receive such a letter you typically have to retain IP counsel to investigate the claim. I doubt a letter "warning other businesses of an impending patent" would be viewed as a "courtesy."   12. I'm an attorney for a big corporation and I understand where you're coming from. I'm not a patent attorney, I do corporate and tax work, but I do have some tangential exposure to these issues. It's my understanding that the type of process you describe and possibly what BF would use is hard to patent. Case in point, one of the products we make are scroll compressors used in commercial and residential air conditioning units. We didn't invent the scroll compressor, I don't know who did, but we do not hold a patent or a license to keep other competitors out of the market. What we do have is one of the highest SEER rated scroll compressors available. It is used in most of the high end units. We achieve these high efficiency ratings through a very detailed and secret manufacturing and machining process. We cannot get a patent on this process or we would, so it is a closely guarded secret. Machining concentric steel cylinders isn't exactly novel or new, so it cannot be patented no matter how well we do it. I can't see how the laser cutting of foam by BattleFoam is unique enough to warrant a patent over the thousands of other companies that do it.
  13. That isn't entirely accurate. The lawsuit was dismissed due to jurisdictional issues, but the judge went out of his way to point out that he didn't believe the suit had any merit. I can post a copy of the decision and point out specific things the judge said in the order, plus his reference to Rule 11( which make this abundantly clear.
  14. Unless something has changed which I doubt, what you say is why BattleFoam has a patent application and not a patent. One is protectable the other is not and may be a pipe dream. One of the reasons you do not see as many of these lawsuits in the U.K. as in the U.S. is that the loser of a case typically has to pay the winner's court costs. It puts a serious damper on frivolous/harassing lawsuits. We have a similar concept in Rule 11( sanctions which the judge referenced in BattleFoam's suit against Outrider when he tossed the case, but it's rarely enforced in this country. It's much less accepted here, for the most part lawyers try to have a congenial relationship and not resort to such heavy handed tactics. Although you always have some that want to push the envelope with everything.
