Yet another vantage point query

Heya, just wondering if this is even a consideration when it comes to vantage points. As the rules sorta say you just look at it from the side and thats it.

if the attacker is within its Ht of the edge and therefore ignoring the ledge, it doesnt have LOS to model drawing lines diagonally (side view).

 

But what if the target was not completely covered by terrain (top view)?

To explain it another way, if you think about the side view, there is more than one side view possible. To wit, if you rotate your viewpoint a bit, you have an entirely different view than you did before. Therefore, since you can come up with at least one side view in which a diagonal LOS can be drawn, you have LOS. You could come up with a view in which the 3" height is directly in front of the 2" Height, and draw a Diagonal Line that way.
