Malevolence/abra cadaver + los

Question

I just wanted to double check the ruling on summoning/placing a model and line of sight.

lets say for example mcmourning embalms a creature with a 50mm base and wants to put the flesh construct on the direct opposite side of the creature, where he has no Los (through the soon to be dead 50mm creature) can he do that?

i have the exact same question about kirai s malevolence ability?

Malevolence does not require LoS as it is an ability. Actions that summon require LoS however, so I think McMourning still needs LoS prior to the other models removal.

Why? Kirai s ability is a summon, it doesn't specifically declare it ignores Los. Both kirai and mcmourning have Los to the target (creature taking dmg and creature getting embalmed to death) why does kirai's ability ignore Los and mcmournings doesn't?
